Image Upload Disclaimer for Gift Card Service

Effective as of November 30, 2023

By uploading any image to Koalesce Designs LLC (“the Company”) on our product’s website diversityavatarstickers.com, for the purpose of creating and sending gift cards, you agree to the following terms and conditions:

1. Ownership and Permissions: You affirm that you own the rights to the image or have obtained all necessary permissions for its use. You further grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, distribute, and display the uploaded image solely for the purpose of creating and sending gift cards.
2. No Violation of Rights: You warrant that the image does not infringe upon any intellectual property rights, including but not limited to copyright, trademark, or privacy rights of any third party.
3. Content Guidelines: Uploaded images must comply with all applicable laws and regulations and should be suitable for the purpose of creating gift cards. The Company reserves the right to reject or remove any content that violates these guidelines, without prior notice.
4. No Liability for Content: The Company disclaims all liability for any loss, damage, or harm resulting from the use or reliance on any uploaded image for the creation and sending of gift cards. Users upload images for gift cards at their own risk.
5. Monitoring and Moderation: The Company may, but is not obligated to, monitor, moderate, or reject uploaded images that do not comply with these terms or are otherwise unsuitable for the creation of gift cards.
6. Indemnification: You agree to indemnify and hold the Company harmless from any claims, damages, losses, or liabilities arising out of or related to the uploaded image for the creation and sending of gift cards.
7. Changes to Terms: The Company reserves the right to modify these terms at any time. Continued use of the image upload feature for gift cards constitutes acceptance of the modified terms.

By uploading an image for the creation and sending of gift cards, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
